This Agreement is entered into between Pawfect APP members (hereinafter referred to as "Members") and Pawfect APP (hereinafter referred to as "Pawfect APP") regarding the automatic renewal deduction service provided by Pawfect APP to Members (hereinafter referred to as "this Service"). This Agreement describes the rights and obligations between Pawfect APP and Members regarding the use and related aspects of this Service. "Member" refers to an individual or single entity enjoying the membership services provided by Pawfect APP. This Agreement constitutes a prerequisite for Members (whether individuals or organizations) to use this Service provided by Pawfect APP. Unless Members accept the terms of this Agreement, Members have no right to use this Service. By choosing to use this Service, Members will be deemed to have agreed to be bound by all terms of this Agreement.
This Service is designed to meet Members' needs for automatic renewal. Under the premise that Members have activated this Service, it aims to prevent Members from suffering losses due to failure to renew in time caused by negligence or other reasons. Members irrevocably authorize Pawfect APP to deduct the subscription fee for the next billing cycle from the Member's own recharge account and bank cards bound to the Member's account (hereinafter collectively referred to as "Account") when the Member's validity period is about to expire. The implementation of this Service is premised on the Member having bound their Pawfect APP membership account with the aforementioned Account, and being able to successfully deduct from the aforementioned Account.
Based on the premise of Section 2.1, Pawfect APP collects the Member's subscription fee for the next billing cycle through the aforementioned Account. Members must ensure that Pawfect APP can successfully deduct from the aforementioned Account. Members shall bear the responsibility for renewal failures caused by insufficient deductible balance in the aforementioned Account.
When enjoying this Service, Members shall be bound by the "Pawfect APP Membership Service Agreement". When Members use this Service, the Member's use behavior shall be deemed as their consent to the service terms of this Service and various announcements issued by Pawfect APP regarding this Service.
This Service provided by Pawfect APP to Members is limited to use on the Pawfect APP platform. Any behavior of separating the content of this Service provided by Pawfect APP from the Pawfect APP platform by illegal means such as malicious cracking does not belong to this Service stipulated in this Agreement. The actor shall be responsible for all legal consequences arising therefrom, and Pawfect APP will pursue the legal liability of the actor in accordance with the law.
Pawfect APP is responsible for providing Members with inquiry methods regarding specific circumstances of automatic renewal charges, but is not responsible for printing and delivering relevant invoices to Members.
Pawfect APP shall deduct the subscription fee for the next billing cycle from the Member's aforementioned Account on the same day, record the payment in the Member's payment record, and extend the Member's validity period accordingly.
If errors occur during the deduction process, Pawfect APP and Members should cooperate closely to identify the cause, and each shall bear the losses caused by their own faults; if losses are caused by unequal faults on both sides, both parties shall bear corresponding responsibilities according to the degree of fault; if both parties share responsibility, both parties shall share the responsibility equally.
Pawfect APP may change or modify the relevant service content, rules, and terms of this Agreement according to its business development or technical upgrades. Before making the above changes or modifications, Pawfect APP will announce the modified content on the relevant pages of Pawfect APP, but has no obligation to provide individual notice separately. If Members do not agree with the modifications to this Agreement, they may cancel the services already obtained and stop using them; if Members continue to use the services provided by Pawfect APP, it shall be deemed that Members have accepted all modifications to this Agreement.
Members may choose whether to cancel this Service independently. If Members choose not to cancel, it shall be deemed that Members agree that Pawfect APP will make deduction attempts from time to time according to certain rules. Once the deduction is successful, Pawfect APP will activate the subscription service for the next billing cycle for Members.
If the price of Pawfect APP subscription service is adjusted at the time of or before automatic renewal, the currently effective price shall prevail.
Pawfect APP does not charge any fees to Members for activating this Service, but Pawfect APP has the right to decide whether to charge for this Service itself or adjust the automatic renewal cycle and fees according to business needs or market changes, and will announce such changes to Members on relevant pages.
This Agreement shall take effect after the Member chooses to accept or use this Service, and shall terminate when the Member terminates this Service/cancels their membership.
Members have the right to choose to terminate this Service at any time in the member account settings. After termination of this Service, Pawfect APP will stop providing this Service to Members.
The instructions for automatic renewal deduction that Members have entrusted to Pawfect APP before choosing to terminate this Service remain valid. Pawfect APP will not refund the fees deducted based on such instructions, and Members shall bear the relevant responsibilities.
If one party breaches the contract, the non-breaching party has the right to obtain compensation through the dispute resolution method agreed upon by both parties.
Pawfect APP and Members shall resolve disputes arising from the performance of this Agreement through friendly negotiation. The interpretation, validity, and enforcement of this Agreement and other related issues shall be governed by the laws of the People's Republic of China.
